The Prison Math Problem: Why Andy Burnham's Jail-Clearing Plan Is a Test for the Next Economy

The prison cell is the most expensive piece of real estate in Britain. Each one costs roughly £50,000 a year to maintain, and the country is running out of them. So when Andy Burnham, the mayor of Greater Manchester, floated a three-part plan to free up space — deport more foreign offenders, release more female prisoners, and review indefinite sentences for lower-risk inmates — he wasn't just talking about criminal justice. He was talking about capacity, capital, and the brutal math of a system that can no longer afford its own promises.
Burnham's urgency is personal. He has vowed that the killers of PC Andrew Harper, Albert Bowers and Jessie Cole, will not walk free early. The pair were jailed for 13 years in 2020 for manslaughter, and Burnham has asked Justice Secretary Alex Norris to examine the options. But the deeper story is structural: England and Wales are in a prison crisis that has been decades in the making, and Burnham's proposals are a stress test for how governments can innovate under pressure.
The first lever — deporting foreign nationals — sounds simple. There are 10,134 foreign prisoners in England and Wales as of June 2026. Remove them, and you free up the equivalent of about 10 average-sized prisons. But every government since Tony Blair has tried this and failed. The reasons are instructive: reciprocal deportation agreements take years to negotiate, many prisoners are undocumented and cannot be sent anywhere, and some simply refuse to leave. Andrew Neilson of the Howard League for Penal Reform calls it a 'long game, not a quick fix.' Tom Wheatley of the Prison Governors' Association points out that small-boat arrivals often have no identity papers, making deportation a legal and logistical quagmire.
The second lever — releasing female prisoners — is more promising but politically explosive. Women make up a small fraction of the prison population, and many are serving short sentences for non-violent offences. The case for releasing them is strong: they are less likely to reoffend, and the social cost of locking them up is often greater than the benefit. But the optics are terrible. A government that appears to be soft on crime, especially after a high-profile murder, will be savaged in the tabloids. Burnham knows this. That's why he is framing it as 'smart justice,' not leniency.
The third lever — reviewing indefinite sentences for 'lower-risk' prisoners — is the most innovative and the most dangerous. Indefinite sentences were designed for the most dangerous offenders, but the system has become a dumping ground for the forgotten. Many prisoners serve years beyond their minimum term because they cannot prove they are safe to release. The review would essentially create a new class of 'low-risk lifers' who could be moved to open conditions or released under strict supervision. This is where data analytics could transform the system: risk assessment algorithms, behavioral monitoring, and predictive modeling could identify who is genuinely safe to release. But the history of algorithmic parole is mixed, and a single failure would end the experiment.
Burnham's plan is not just about prisons. It's about the future of public infrastructure. The UK is facing a similar crisis in housing, healthcare, and transport: too much demand, too little capacity, and a political class that cannot agree on how to pay for it. Prisons are the canary in the coal mine. If Burnham can find a way to reduce the prison population without increasing crime, he will have demonstrated a model that could be applied elsewhere. If he fails, the lesson will be that the system is too rigid, too political, and too stuck in the past to change.
The money is real. Every prisoner released saves the state £50,000 a year. That is enough to fund thousands of new homes, or to invest in the technology that could prevent crime in the first place. The question is whether the political courage exists to take that money and reinvest it in something smarter than another cell block.
Burnham is betting that he can thread this needle. He is not a billionaire, but he is acting like a venture capitalist: taking a bold, contrarian bet on a distressed asset, and hoping to unlock value that others have missed. The difference is that his shareholders are the voters, and the dividend is public safety. If he succeeds, he will have shown that the next economy is not just about rockets and chips — it is about rebuilding the basic systems that keep society from falling apart.
